Abstract
This law review article critically examines the rigorous entry requirements, disproportionate odds, and enduring stigma faced by Iranians seeking visas to the United States and European Union member states. The paper highlights the cyclical pattern of punitive visa denials during politically opportune periods, shedding light on the significant barriers that impede ordinary Iranians’ access to the West. Additionally, it explores potential biases and challenges within the visa systems and legal frameworks of the U.S. and E.U. that uniquely impact Iranian applicants. The article also delves into the escalating measures taken against individuals, including Iranians, seeking refuge or asylum in Western nations, while exploring the arbitrary difficulties posed by European consular sections during times of unrest. The fear of visa overstays is examined as a driving factor behind the denial of visas, often without reasonable correlation to national interests. Furthermore, the article addresses the implications of nationality-based judgment and national security concerns arising from these actions, drawing comparisons to more ethical visa regimes and proposing potential legal remedies.
