Abstract

This article describes in some detail the role that the intoxication of the accused plays in establishing their criminal culpability within the criminal law in New South Wales. It concludes that a wide divergence of approaches is taken in respect of this issue across the web of potentially relevant legal principles. In some cases there is a divergence of approaches across the range of judgments dealing with any particular thread of the web.
