Abstract

This paper aims to demonstrate that, despite the prevalence of electronic transactions, negotiable instruments remain an essential legal tool for transferring financial obligations or rights in Malawi. Negotiable instruments offer ease and legal protection, but they also include risks, such as loss, theft, dishonour, and signature verification. As a result, it is a truth that we live in a modern society where electronic transactions have greatly increased, a phenomenon known as e-transactions. Nonetheless, the world's financial and commercial legal systems still rely on negotiable instruments, and they coexist. In actuality, Malawi is ready to completely do away with the negotiable instruments.
