Abstract

The duty of impartiality and independence imposed upon arbitrators and mediators is critical to the healthy functioning of the dispute resolution sector both globally as well as in Hong Kong. This article explores the legal framework regulating impartiality and independence in the arbitration and mediation setting. Focus is specifically placed on legislation, case law, and institutional rules in Hong Kong which lay the groundwork for such duties.
