Abstract

In the context of Brazil potentially importing regulatory approaches similar to the Digital Markets Act (DMA) in light of the DMA's recent entry into force in Europe, this paper raises questions regarding the need for changes to the competition defense system. Considering this framing, the paper briefly summarizes the lack of international consensus on the need for ex-ante regulation of digital platforms. It also points out that the Digital Markets Act (DMA) cannot be considered a global best practice, emphasizing the importance of continuing to debate and improving traditional competition approaches for platforms, especially considering the complexities and challenges present in this constantly evolving environment.
