Abstract

The offence of Rape is one of the most gruesome and barbarous crimes perpetrated against women. It is an act which demolishes the entire physical and psychological composure of a woman and reduces her as a living corpse. The severity of crime and the effect of this cruelty acquires an increased intensity in the case of a woman who is raped by her spouse. But strangely enough, the legislators have turned a deaf ear to all pleas of justice by married women who, time and again, have been tortured and forced upon by their husbands. This article seeks to look into the offence of marital rape, its impact on the victims, arguments for and against criminalisation and the Indian standpoint.
