Abstract

This article argues that the "tort reform" debate in Australia has largely taken place without reference to the empirical and social context in which accidents and injuries occur. In fact, the so called liability crisis has far more complex origins which cannot readily be resolved by changing tort law.

Keywords: negligence, tort reform, public liability
