Abstract

A discussion of student speech that could be considered distracting to some together with a discussion of the lack of consistency in the law in applying the First Amendment in cases before the court. Tinker is one of the most notable cases for the rights of student free speech and the decision and how it relates to current cases is examed in a thorough manner.
