Abstract

This note examines the emerging trend in company law to accommodate employees' interests as stakeholders in the company. The note examines this trend in the context of Irish company law with reference also to UK company law. The note posits that the present state of the law is merely symbolic as the duty introduced to safeguard employees' interests is practically unenforceable. The note suggests how this asymmetry can be overcome in Ireland's context.
