Abstract

The American consumer bankruptcy system is costly and consequential. Between 2008 and 2023, consumers filed 13.8 million cases, generating over $4 billion in court filing fees alone. Against that backdrop, this study uncovers a startling phenomenon: nearly 46% of consumers who filed bankruptcy in 2023 were repeat filers, up from 37% in 2016. Significant geographic disparities exist, with the Western District of Tennessee reporting 76% repeat filers compared to just 36% in the Southern District of West Virginia. While repeat filing has historically been concentrated in the South, elevated rates now appear in jurisdictions like Pennsylvania and Utah.

As the first comprehensive national study of bankruptcy recidivism covering both Chapter 7 and Chapter 13, this Article leverages credit report data and court records to challenge prevailing assumptions. Contrary to the narrative that serial filings reflect bad-faith debtors exploiting Chapter 13, the majority of repeat filers had previously received a discharge (nearly half under Chapter 7) and most refile only after a gap exceeding seven years. 

The study further shows that prior bankruptcy is a robust predictor of future filings, even after controlling for financial and demographic factors. By shifting focus from short-term Chapter 13 abuse to broader structural patterns, this Article offers a new framework for understanding consumer bankruptcy and urges reevaluation of how the system addresses debtors' enduring financial vulnerabilities.
