Abstract
English abstract: This article aims to briefly explain the title of the event that gave rise to this book – The Thought of Robert Alexy as a System: legal argumentation, fundamental rights, concept and validity of Law. That is, it targets to expose how Robert Alexy's thought is articulated in a system. The following articles, corresponding to the lectures of professors invited to the congress, address specific aspects of the Alexy’s work In the title of the congress, the three books that Alexy wrote are mentioned. The first two books are the basis of his thought, they are the publication of his doctoral thesis “Theory of Legal Argumentation” (Theorie der juristischen Argumentation, defended in 1976 and published in 1978) and his Habilitation thesis “Theory of Constitutional Rights” (Theorie der Grundrechte, defended in 1984 and published in 1985). Between these books and the third one, Alexy continued to develop his thought in about thirty articles. In 1992 he published his third and last book “Concept and Validity of Law” (Begriff und Geltung des Rechts). Since then, Alexy continues to enrich and improve his work not in books, but in articles (from 1992 to 2016, one hundred and eight articles were written, translated into more than twenty languages). The German jurist remains, even today, in great intellectual production. Therefore, this article highlights the main ideas developed in each book, and at the end presents the last topics approached by Alexy, in order to underline the systemic totality of his work.
Portuguese abstract: Este artigo integra livro de igual título organizado pela autora, obra resultante do Congresso Internacional em Direito e Inovação – O Pensamento de Robert Alexy como Sistema: argumentação jurídica, direitos fundamentais, conceito e validade do Direito, realizado em 2015 na Faculdade de Direito da Universidade Federal de Juiz de Fora.
Neste artigo, a autora pretende expor como o pensamento de Robert Alexy se articula em um sistema. No título do artigo, são mencionados os três livros que Alexy escreveu. Nos dois primeiros, está a base do seu pensamento. Não por outro motivo são a publicação da sua tese de doutorado Teoria da Argumentacao Juridica (Theorie der juristischen Argumentation, defendida em 1976 e publicada em 1978) e tese de Habilitation Teoria dos Direitos Fundamentais (Theorie der Grundrechte, defendida em 1984 e publicada em 1985). Entre este e o terceiro livro, Alexy continuou a construção de seu pensamento em cerca de 30 artigos. Elaborou então, em 1992, seu terceiro e último livro, Conceito e Validade do Direito (Begriff und Geltung des Rechts). Desde então, Alexy segue desenvolvendo, aperfeiçoando e enriquecendo sua obra não em livros, mas por meio de artigos (desde 1992 até 2016, foram escritos 108 artigos, traduzidos para mais de 20 idiomas). E o jurista permanece, ainda hoje, em grande produção intelectual. Neste artigo, serão destacadas as ideias principais desenvolvidas em cada livro, com a exposição, ao final, dos últimos tópicos tratados por Alexy, de modo a restar clara a visão da totalidade de sua obra e sua compreensão sistêmica.
