Abstract

Due to recently increased enforcement activity by the DOJ against non-US companies, referred to as domestic concerns, managers running multinational corporations and compliance officers are justifiably concerned about newly emergent questions of compliance. Organizations are expected to reassess the impact of leadership on the conduct of subordinates.

This paper looks into which Leadership style is presupposed by U.S. legal framework, suggesting that Transactional Leadership in middle management is most compatible with updated guidelines promulgated by the U.S. Department of Justice (DOJ) and the Securities and Exchange Commission (SEC) and highlights one necessary amendment to compliance management.
