Abstract
The sale of used cars is a big business, and frequently results in heartache to the consumer who finds that the car is defective. The seller, however, is usually quite adept at constructing a contract that shifts all risks to the buyer. This article enumerates a number of claims that the buyer may have. Reference is made to state and federal law as well as to the common law. The author concludes with a number of reforms that might level the playing field.
